We really appreciate your business. Please review these Purchase and Shipping Terms carefully—placing an order means you agree to these terms, which form the agreement between you and Gemfish Opals Pty Ltd (trading as Black Opal Direct, ABN 18 050 293 993).
Purchases
You must provide complete and accurate details at the time of making your purchase. You may be required to provide additional details upon our request to ensure the accuracy of your order.
You must enter the correct delivery address and delivery instructions at the time of placing your order. If you enter an incorrect address, Black Opal Direct is not obliged to re-send the order to the correct address at our own expense. Please email us immediately if you submit your order and then realise that you have entered an incorrect delivery address or delivery instructions.
Purchase Price
All prices quoted on the Website, or pursuant to any enquiry that you may make with us, are in United States Dollars (USD). International orders do not include GST. We also display prices in Australian Dollars. All orders in Australian Dollars (AUD) with a delivery address in Australia include GST.
We reserve the right to vary the prices displayed on the Website from time to time and without notice to you.
Our prices include insurance but do not include any secondary attempts to deliver Items to you.
Payment
Black Opal Direct accepts payment via PayPal, Visa, Mastercard, American Express and direct transfer (Australian and US customers only – other international customers by prior agreement only).
After you make payment for your order, you will receive a transaction confirmation email, which confirms receipt of your order.
In the event that Black Opal Direct does not receive cleared funds after 48 hours of you submitting your order, we will email you at the email address nominated in your order to communicate about your payment.
Security
We recognise that protection and safety of information relating to your credit card is very important. Therefore, we provide you with a very safe and stress-free online shopping experience.
We are PCI-DSS compliant and we do not store your credit card details at any time so consumer confidence and satisfaction is assured at all times.

Processing of Orders
Orders made via our Website will typically be processed within two (2) business days of your order being made and payment being received from us in cleared funds.
Order Pickup
By arrangement only: If you’d like to collect your purchase in person at our Arundel studio, please contact us ahead of time to confirm availability and arrange a pickup appointment.
Shipping
Domestic Shipping (Australia)
Carrier: Australia Post Express Post - every shipment requires a signature on delivery.
High-value items will be sent via TNT Failsafe secure courier (street‐address delivery only), also signature required.
International Shipping
Items up to USD $500: DHL courier to your local postal service.
IItems USD $501 and above: FedEx International Priority.
**Authority to Leave:** We strongly recommend cancelling any “Authority to Leave” instructions for FedEx deliveries. We aren’t liable for packages left unattended. If you prefer, we can have FedEx hold your package at a specified FedEx location instead.

These are estimates only. Peak periods (e.g. Christmas) may take longer. You’ll receive tracking details once your order ships. If you haven’t received your package within these windows, please email your full name and order number so we can investigate.
Note: Providing an incorrect address may delay delivery and incur extra charges.
Damaged or Missing Items
If your package arrives damaged, please keep all packaging and contact us immediately so we can assist with a claim.
Customs, Duties & Taxes
Your responsibility: All customs duties, VAT, GST or other taxes.
Documentation: We include complete paperwork for every international shipment. There may be additional paperwork required to comply with taxes and duties in your specific country.

Additional U.S. Import Information (Effective 5 April 2025)
10% Tariff on imports over USD 800 (Australia origin), collected by FedEx from client.
Merchandise Processing Fee still applies.

Shipments over USD 2,000 require your Social Security Number or EIN.

Provide this via email for shipping or complete FedEx’s CBP Form 5106 within five days of request—otherwise FedEx may return the shipment at your expense.
Jewelry Under US-Australia FTA:
Generally only subject to the 10% tariff, but FedEx may sometimes apply a 5.5% duty above the USD 800 de minimis. Contact FedEx for specifics.
Cancellation of Orders
By us: If we can’t supply your items, we’ll notify you and cancel your order. No compensation for inconvenience applies.
By you: Cancellations are only possible if we expressly agree in writing. Once item has shipped it is unabled to be cancelled.
Risk & Insurance
Packaging & Insurance: All orders are securely packaged and insured for full value.
Liability: Once the carrier confirms delivery, all risk transfers to you. We can’t be held responsible for loss or damage after delivery. Please ensure all “Authority to Leave” instructions with Fedex are cancelled prior to delivery.
